TERM OF COMMITMENT
BFiTT agrees to commit to helping you to achieve your goals in any reasonable amount of time. We further agree and commit to holding you accountable for yourself and your training to ensure that you stay on track and achieve your goals. In turn, you agree to commit in full to the minimum term of your contract, attending all sessions as prescribed by your coach/therapist and paying all fees in full as they fall due. BFiTT is a community and, as such, relies on its team and members to support each other through participation and positive attitudes. By attending BFiTT, you agree to being part of our community and to behave accordingly. We reserve the right to suspend/cancel/terminate any training arrangement due to non-payment of fees or failure to act in a positive and/or supportive manner. Negativity towards our team and/or members of any kind will not be tolerated. Of course, constructive feedback via proper channels is always welcome.
THERAPISTS, TRAINERS, COACHES, INSTRUCTORS & TEAM MEMBERS
All contractual agreements and their associated obligations are to BFiTT as an entity at all times. No contractual agreement is conditional on personnel. BFiTT reserved the right to substitute any trainer, coach, therapist or instructor at any time with notice or penalty. Substitution of personnel shall not be considered breach of contract nor grounds for termination of contract. If you would like to change Personal Trainer or Coaches, for any reason, please discuss with our Training Manager and she/he will be happy to assist you. Refunds or cancellations will not be provided under these circumstances. Should you experience any pain, discomfort, or injury, during any of your sessions, you must inform your Personal Trainer, coach or instructor immediately. Prior to, or during, the course of your training, health concerns may arise that may require further input from your doctor, physiotherapist or other allied health professional. Your Personal Trainer may request your assistance in obtaining that information. Please be aware that your Personal Trainer cannot diagnose and/or prescribe treatment for any form of injury, disease, or other medical problem.
PAYMENT TERMS
All payments for all services are to be paid up front and in full, with the following exceptions:
Direct Debit arrangements (DD). These arrangements are at all times to be paid "in advance" of services, with each period to be paid in full at the beginning of each autopay period. Any services "invoiced" are due in full within 7 days of the invoice being issued. The client attending the session is, at all times, liable for all fees due. All DD payments are processed by our third party merchant processors and may be subject to further conditions. Post-pay and "cash on the day" options are not available for any services. Payment must be made in advance of any training sessions taking place. Any membership access or periodic access arrangements for BFiTT sessions (eg: Monthly memberships or billing) is applied to your account on a schedule. These sessions expire and are forfeited at the conclusion of each period. Eg: For a monthly pass, any sessions not taken/used within the associated 30 day period will be forfeited. Any services provided under a funded program such as NDIS, DVA, Medicare, Open Arms or any other body with agreement to pay for client services in part or in full where said service declines to pay for services invoiced or rendered, shall at all times be the sole financial responsibility of the client who received said services.
MINIMUM TERMS
Any training programs or packages that are subject to an initial fixed term (16 weeks unless otherwise stated) are minimum term and fees are due in full regardless of member attendance or use. At the conclusion of any minimum/fixed term, all programs automatically renew into an ongoing "month to month" access subscription which remains in force until further notice until terminated in accordance with our cancellation policy terms by the client or an authorized party. Our fees are reviewed periodically and may change from time to time. We will give you at least 14 days’ notice of the proposed change by emailing you at the email address you have provided for us.
SUSPENSION OR CANCELLATION OF YOUR PROGRAM OR SUBSCRIPTION
For cancellation of any appointment or class, we require 48-hours’ notice of any cancellation. (Shorter cancellation windows may be available via the BFiTT App for some session types) Failure to give appropriate notice will result in fees paid being forfeit or your account/card being billed at the full session rate. For cancellation requests made at 48 of your scheduled appointments, you may be offered the option to reschedule (within 7 days) if available. If no suitable time is available, our normal cancellation terms will apply. Failure to appear for a scheduled session will constitute non-compliance with this policy and our standard cancellation terms will apply. Fixed or ongoing programs cannot be cancelled inside the minimum term. Coaching programs are fixed term and able to be provided both face-to-face and remotely. These are for the purpose of building consistent habits and thus, cannot be suspended. Class programs and subscriptions may be suspended upon request when travelling out of town for work, leave or other reasonable requests. Please allow a minimum of 14 days for any email request. Some programs may have longer notice periods. Suspension requests of upto 4 weeks can be accepted (longer periods will be considered on a case-by-case application which can be emailed direct to the coach/therapist in charge of your program). Direct Debit payments can only be cancelled after any minimum initial payment value has been completed and the account balance is $0.00. After this time, any cancellation of Direct Debit must be made at least 30 days prior to your next scheduled Direct Debit payment by providing notice via email at [email protected]. Once a program or subscription has been cancelled, any and all sessions, visits or entitlements received as part of, or as a bonus to, this Agreement will expire and be void. No services, visits or sessions shall be available during periods of suspension or after the date of termination. Any unused sessions at the time of cancellation will be forfeit.
NDiS Service agreements and other funded programs can be ended at any time by giving a 30 day written notice via email to [email protected]. Any services attended, requested, booked or scheduled during this time shall be billed at the standard full rate.
REFUNDS AND TRANSFERS
All initial packages and programs are offered on a "fixed term" basis. Any subscriptions or casual services are offered on an ongoing “until further notice” subscription basis. All services and sales are final. Any deposit paid shall be considered non-refundable. If you are unable to continue your scheduled sessions for medical reasons, a longer-term suspension may be considered. Any remaining sessions may be held on your account for up to 6 months. You may be required to submit a letter from your specialist clearly detailing the exact exercise restrictions prior to a suspension being considered. Please note that medical certificates from a GP are not considered sufficient. If reasonable, we will consider transferring the remaining sessions to rehabilitation sessions with one of our Movement Therapists. Refunds are not available for any used or unused services paid for in the past, present or future under any circumstances. All services are provided by our team, as a team. While it would be a last resort, BFiTT reserves the right to switch to your regular therapist, coach, trainer or instructor, either on a temporary or permanent basis, without penalty. If your regular trainer is away on holiday or sick leave, they (or we) will arrange a temporary replacement trainer for the duration of their absence. Refunds will not be given on sessions that have to be rescheduled under these circumstances. If your regular trainer is no longer employed by BFiTT, our Training Manager will allocate you another trainer/therapist who is suitable to your needs, and will supply them with your complete training history. Refunds will not be provided under these circumstances. You may not transfer your program or sessions to another person. Any remaining sessions must be delivered prior to the cancellation date of your program and any owed sessions will be considered expired and void on this date. In a case where a client transitions from a program member to a casual member, owed/unused sessions will also not be available for use past the final date of their program during a casual membership. No refunds will be given for unused sessions.
COOLING OFF PERIOD
BFiTT offers a cooling off period in line with the Office of Fair Trading of Australia. This cooling off period is available where no services have been used up to and including 5 days from the initial date of signup. The date of any signed contract or initial payment, whichever is earlier, shall be considered day one (1).. An administration fee equal to (4) four weeks at the agreed regular scheduled payment value as per the contract in question shall be payable immediately on request to enact the cooling off period. This fee covers costs of time, acquisition, consultation time, staffing hours and cost of goods supplied incurred up until this point. Any used, attended or booked sessions shall be billed and payable immediately in addition to this fee at our standard rates, current at that time. Any initial non-refundable deposits may be considered as part payment of administration fees. However, these remain non-refundable under all circumstances.
LATE ARRIVALS / NO SHOWS
Our cancelation period states sessions canceled with more than 48 hours notice are not charged. Sessions cancelled between 24-48 hours' notice may be offered and be rescheduled if available. Sessions cancelled 24-48 hours where a reschedule is not available, within 24 hours, or where you do not attend, are forfeit and non-refundable. If your trainer or therapist is more than 10 minutes late for your 1:1/ private fitness session, you will receive a free session from that trainer, arranged at a mutually convenient time for you and your trainer. For group programs, you will be given your next group session at no charge. Sessions are booked and run for a specific time period, not a specific length of time. Your session booking
will not be extended for any reason
if you fail to arrive on time for your book time. You are booking the time on your coaches calendar, not yours. If you are late for your session, your session length will be deducted accordingly, and end still end at the originally scheduled end time. You will still be charged at the full scheduled rate. If you’re more than 15 minutes late without contacting your trainer, the session may be cancelled, and you will be charged for the full session.
DRESS CODE & EXPECTED BEHAVIOUR
BFITT is a JUDGEMENT FREE zone and SUPPORTIVE Community. As such, we have a ZERO TOLERANCE policy on bullying, harassment and being nasty in general. All all times, we reserve the right to terminate the services of any person who devalues experience any way for another person in our greater community.
By participating in our sessions, you agree to adhere to and uphold our values at all times. Comfortable clothing is acceptable providing that it is not offensive and it covers you appropriately. Basically, keep it PG. Covered and stable shoes must be worn for all sessions, and left on for the entirety of the session unless instructed by the coach in charge of the session. We have worked to build a positive and supportive community to make getting fit and fun. We ask that when you speak to, or about, other members you ask yourself:
- Will what you’re about to say build up and help the person of whom you are speaking?
- Is it positive?
Bottom line… be nice and don’t be a jerk to our team, the people around you, our community, and yourself.
MEDIA RELEASE
From time to time, BFiTT records full or parts of sessions for the purpose of training and marketing purposes. That may consist of, but is not limited to: Video, photo, Live broadcasts, Audio recording, aerial videography/photography. By attending any session arranged or conducted by BFiTT, or its representatives, you authorize all media to be released and used by BFiTT Pty Ltd in any means relevant to the promotion of any goods and services offered, owned, or endorsed by BFiTT Pty Ltd, its Directors or any parties authorized by BFiTT Pty Ltd to use such media on its behalf or for any other reason. These uses include, but are not limited to, Facebook, Instagram, our website, printed equipment, posters, TV, radio, music, Live Broadcasts and educational equipment for our staff and members. You may also be asked on a regular basis to appear in various videos and other media to build our following and engage with our, or any other, audience for promotional, educational and/or engagement purposes. Participation in these activities is optional but doing so shall constitute acceptance and further agreement to this release and approval to use all media as listed above. BFiTT Pty Ltd and its Directors shall remain the sole owner of all such media for the indefinite future. You will have no course to pursue for compensation, reward, cease of use or any other request prior to, or during, nor after termination of any access pass or program term.
